The Local Market
These regulations apply to all stall holders. Strict compliance with them is a term and condition of the contract for the use of a stall site on any of our event. It is essential that all stall holders cooperate and play their part in ensuring that The Local Market events are profitable, unique, enjoyable and safe for everyone. This includes complying with the commercial and administrative terms (specially regarding bookings and payment), trading standards guidelines, food hygiene and the risk management and accident prevention terms.
Merchants are invited to attend any of The Local Market event. Stall holders are invited entirely at The Local Market's discretion. Please do not assume a regular pitch is automatically yours. Please submit your registration. Confirmation of attendance is by return email and in doing so the trader automatically agrees to the terms and conditions. Please read it careful and do not hesitate to contact us if there is any questions.
Payment must be made within 7 days after the date of the approval. Payment should be made by bank transfer to the appropriate bank account for the event or through our online payment system. Late payments taken as cash on the day will incur an administration fee.
Stall holders must accept the risk of bad weather and will not generally be entitled to a refund for these reasons. Refunds due to bad weather will be at the Operators discretion. Any refund must be bring forth with reasons beyond the stall holders control and at the discretion of the Operators to be able to find a replacement stall holder.
Stall holders are expected to trade for the duration of the event. Please be advice that there is a certain time for set up as the stall has to be ready 1 hour before the opening time. Any variation to these times will be notified by the Operator prior to the event.
Allocation and Position of Pitch
The Operator is solely responsible for the allocation and position of pitch sites. It is not permissible for stall holders to change the pitch position without consultation with the Operator. Nailing, pasting or using any types of adhesive to the existing walls, rooms or building is not permitted. Any property damage will be incurred to the trader. Plastic banners of any kind is highly discouraged.
Online check out service
We provide traders to complete a transaction using credit card or bank transfer service through our online platform. Please do not forget to subscribe if you are interested and we will send you the detail information.
On application traders are to supply a description and social media accounts of the goods intended for sale. All products must be made by the traders themselves. No resellers are allowed. Any additions / amendments to this portfolio must be approved by the Operator. The Operator will ask for any non authorized goods to be removed from display.
Exclusive Trading Rights
The Operator will try to prevent duplication of products within the event but does not guarantee exclusivity. Each trader needs to be present and showcase / interact their products directly to the buyer. No use of sales person is allowed as this is an artisan market where buyers will make the connection directly with the makers. Each trader must wear the passes provided for each stall holder during trading hour. Each stall holder will be given 2 passes. Any extra will be charged Rp 100,000 per pass.
Extra electricity must be requested at the time of the registration. Addition on the day of will be not be entertained.
Site Use And Presentation
Stall holders must operate strictly within the marked boundaries of the stall site that has been allocated to them, to avoid encroachment into neighbouring trader pitch space. The presentation of stalls must be of a professional standard that is satisfactory to the Operator. Stall holder supplying their own infrastructure must ensure that it is good quality and weighted appropriately. Gas safety certificates must be provided for all gas appliances.
Smoking is not permitted in the vicinity of the event. Designated smoking area will be set up outside the building, away from the entrance. Setting Up, Closing Down, Loading And Unloading: Stall holders must set up, close down, load and unload strictly within the specified times and guidelines given for each event. Any stall holder that are a no show or late in setting up will automatically be cancelled at the discretion of the operator. Setting up must be complete 1 hour before trading starts. Before vacating their stall site, stall holders must remove all rubbish and do all other things that may be reasonably necessary to leave the stall site in the same condition that it was in before they set up their stall.
Bad Weather And Other Disruptions
The Local Market events operate in all weathers and will operate on the designated market day unless extreme weather or other disruptions that are beyond the Operator's control compel the Operator to close the markets for the safety of traders and the public. It is the responsibility of the stall holder to contact the Operator to check if the event is going ahead. The Operator will communicate the cancellation of an event via email, telephone call, messaging services and / or social media.
Stall holders must comply with all directions given to them by the Operator. Stall holders must treat the staff of the Operator, other stall holders and members of the public with courtesy and respect at all times. Any unacceptable behaviour including, but not limited to, aggression, abusive language or refusal to comply with a reasonable direction will be treated as a breach of a condition of these regulations. Such a breach is likely to result in that stall holder being required to leave the market immediately and being banned from trading at any future markets. Any direction given by the Operator regarding risk management or accident prevention must be complied with strictly and immediately.
Operator's Dispute Resolution Determinations
The Operator may make determinations to resolve any dispute that may arise including, but not limited to, disputes between stall holders and disputes between stall holders and customers or other members of the public. The Operators decision is final.
Stall holder's Warranties And Representations
The stall holder acknowledges and agrees that, by applying for a stall site, the stall holder makes the following warranties and representations: That the statements made in the online or paper application are true, accurate and complete. That the stall holder has carefully read these regulations and agrees to be bound by their terms and conditions. That the stall holder has the full legal and beneficial ownership of the goods that they offer for sale and that their ownership is of their own product. That the stall holder will not engage in any false or misleading conduct including, but not limited to, selling counterfeit goods or mislabeling goods. That the stall holder has the necessary licenses, practicing certificates or permission to sell the goods that they offer for sale.
Inspection Of Documents
Stall holders must supply all necessary documentation requested with the booking form.
Exclusion Of The Operator's Liability
The stall holder acknowledges and agrees that the Operator has not given any warranties or made any representations relating to the stall holder's occupation or use of a stall site at The Local Market's events other than as are specifically set out in these regulations. This includes, but is not limited to, any warranties or representations relating to.
The stall holder's likely sales or profits. The benefits of the location of any particular stall site. The number of potential customers that are likely to visit the markets. The presence of other stall holders on the same market day selling the same or similar goods or services or the location of their stall site. The services and facilities that are available to the stall holder other than as are expressly set out in these regulations. The extent to which The Local Market has carried out marketing or advertising to attract customers to the markets. The suitability of the markets for any particular purpose.
Claims Against The Operator
The stall holder acknowledges and agrees that The Local Market is not liable for any claims arising from: Damage to the goods or other property of the stall holder. Theft of the goods or other property of the stall holder, Injury, loss or damage suffered by any person at The Local Market's events. Damage to or the theft of the property of any person at the markets.
Risk Management And Accident Prevention Terms
Stall holders must comply with the Operator's online bookings and payment procedures, to help the Operator's staff to keep track of each stall holders. Stall holders must report promptly to the Operator any security problems including, but not limited to, robberies, shoplifting, pickpocketing or the need to forcibly remove drunken or belligerent customers from the events. Any stall holder using equipment or practices that could endanger the health & safety of any persons will be asked to leave the market.
Stall holders must appreciate that most events are held in a public space. When setting up, closing down, loading and unloading in this area, they must exercise the same degree of care for their own safety and consideration for the safety and convenience of others.
To reduce the risk of tripping accidents, stall holders must keep their stall site and the immediate vicinity clear of anything that might obstruct pedestrian traffic and cause tripping accidents. Stall holders must ensure that their stall sites are free of any sharp corners or dangerous projections that might injure customers particularly of hard materials such as timber, metal or glass.
Stall holder Requirements
Food stall holders must rely on their own public liability insurance to include cover for claims arising from the sale of hot food or from food contamination. Food stall holders must acknowledge and agree that the Operator is not liable for any worker's compensation claim by any of their staff. In the storage, preparation, cooking and service of food, food stall holders must comply strictly with all legal requirements and / or the recognized best practice standards including, but not limited to:
Holding a valid PIRT or BPOM by their local Environmental Health Office. Goods must be marked and priced according to legal requirements.
